1. Definitions and Interpretation
In these Terms and Conditions:
- “Company” means Padel Culture Pty Ltd (ABN 99 697 655 306, ACN 697 655 306), a company registered in Western Australia.
- “Services” means all padel-related services offered by the Company, including court hire, coaching programs, tournaments, leagues, corporate events and equipment hire.
- “Website” means the website located at padelculturepty.site and all associated pages.
- “User” or “you” means any person who accesses or uses the Website or engages the Company’s Services.
- “Australian Consumer Law” or “ACL” means Schedule 2 of the Competition and Consumer Act 2010 (Cth).
2. Acceptance of Terms
By accessing the Website or booking any Services, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Website or our Services. These terms apply to all Users, including casual visitors, registered customers and corporate clients.
3. Australian Consumer Law
Nothing in these Terms and Conditions excludes, restricts or modifies any rights you may have under the Australian Consumer Law (ACL) or any other applicable legislation that cannot be excluded. Where the Company goods or services come with guarantees under the ACL, your right to a remedy for a failure to comply with those guarantees is not limited by these terms.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
4. Services
4.1 Court Hire
Court bookings are confirmed upon receipt of payment. The Company reserves the right to reallocate courts in the event of maintenance, weather or other unforeseen circumstances, in which case a full refund or rescheduled booking will be offered.
4.2 Coaching Programs
Coaching sessions must be booked in advance. The Company requires at least 24 hours’ notice for cancellations. Cancellations made with less than 24 hours’ notice or no-shows will incur the full session fee.
4.3 Tournaments & Leagues
Entry into tournaments and leagues is subject to availability and any published entry conditions. The Company reserves the right to amend draw formats, schedules and venues where reasonably necessary.
4.4 Corporate Events
Corporate event bookings require a signed event agreement and a deposit. Full terms specific to the event will be set out in that agreement; these Terms and Conditions apply to the extent not varied by the event agreement.
5. Pricing and Payment
- All prices are in Australian dollars (AUD) and include GST where applicable.
- The Company reserves the right to change prices without prior notice; however, price changes will not apply to bookings already confirmed and paid for.
- Payment must be made in full at the time of booking unless otherwise agreed in writing.
- Accepted payment methods are those displayed on the Website at the time of booking.
6. Cancellation and Refund Policy
- Cancellations made more than 48 hours before a booking will receive a full refund or credit.
- Cancellations made 24–48 hours before a booking will receive a 50% refund or credit.
- Cancellations made less than 24 hours before a booking or no-shows are non-refundable.
- Refunds will be processed using the original payment method within 5–10 business days.
- The Company reserves the right to issue a credit note in lieu of a refund at its discretion.
These cancellation rights are in addition to any rights you may have under the ACL.
7. Limitation of Liability
To the maximum extent permitted by law, and subject to any rights you have under the ACL:
- The Company’s liability for any loss or damage arising from or in connection with the Services is limited to the amount you paid for the specific Service giving rise to the claim.
- The Company is not liable for any indirect, incidental, special or consequential loss or damage, including but not limited to loss of profits, loss of revenue, loss of data or loss of opportunity.
- The Company is not liable for any injury, loss or damage arising from your misuse of facilities or equipment, or your failure to follow posted safety rules or staff instructions.
8. Assumption of Risk & Waiver
Padel is a physical activity that carries inherent risks. By using our courts and participating in our Services, you acknowledge that:
- Physical activity involves risks of personal injury, including but not limited to sprains, strains, fractures and other injuries.
- You participate in all Services at your own risk.
- You are physically fit and able to participate in the activities offered.
- You will comply with all safety instructions and rules displayed at our venues or provided by our staff.
9. Intellectual Property
- All content on the Website, including text, graphics, logos, images and software, is the intellectual property of Padel Culture Pty Ltd or its licensors and is protected by Australian and international copyright and trademark laws.
- You may not reproduce, distribute, modify, create derivative works from, publicly display or exploit any content from the Website without our prior written consent.
- The Padel Culture name, logo and associated branding are trademarks of Padel Culture Pty Ltd and may not be used without written authorisation.
10. User Conduct
When using the Website or our Services, you agree not to:
- Use the Website for any unlawful purpose
- Provide false, misleading or incomplete information
- Interfere with or disrupt the Website’s infrastructure or other Users’ access
- Attempt to gain unauthorised access to any part of the Website or related systems
- Transmit any viruses, malware or other harmful content
- Engage in conduct that is disrespectful, abusive or dangerous to other players, staff or visitors
11. Termination
The Company may, at its sole discretion and without prior notice:
- Terminate or suspend your access to the Website or Services if you breach any provision of these Terms and Conditions.
- Cancel any booking where it reasonably believes the booking was made fraudulently or in breach of these terms.
- Refuse future bookings to any User who has previously breached these terms or engaged in conduct that is dangerous or disruptive.
Upon termination, any accrued rights or obligations will survive, and Sections 7 (Limitation of Liability), 9 (Intellectual Property) and 12 (Governing Law) shall continue in full force and effect.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of Western Australia. The parties submit to the non-exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia.
13. Dispute Resolution
If a dispute arises out of or in connection with these terms, you agree to first attempt to resolve the matter by contacting us at ceo@padelculturepty.site. If the dispute cannot be resolved informally within 30 days, either party may pursue further action through the courts of Western Australia or alternative dispute resolution as appropriate.
14. Amendments
The Company reserves the right to amend these Terms and Conditions at any time. Updated terms will be posted on this page with a revised effective date. Continued use of the Website or Services after amendments constitutes acceptance of the revised terms.
15. Severability
If any provision of these Terms and Conditions is held to be invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
